Transfer of estates guidance for NHS property published

The Department of Health & Social Care (DHSC) has issued guidance for NHS Trusts and Foundation Trusts requesting transfers of estate in the ownership of NHS property companies (NHS Property Services (NHSPS) and Community Health Partnerships (CHP)).

The DHSC reiterates that the principles under which the land and property assets of the Primary Care Trusts were originally transferred to NHS property companies following the 2012 Health and Social Care Act came into effect still apply. However, it recognises that local circumstances may have changed, perhaps as a result of Sustainability and Transformation Partnerships (STPs) and the move to integrated care.

It further acknowledges that some NHS providers have made representations that local ownership of property may better enable effective delivery of the original principles.

The policy document – downloadable here – sets out the basis on which applications for transfer of assets to NHS Trusts or Foundation Trusts may be made and on what criteria they will be assessed.
